1. HIPAA and protected health information

When you set up an account with Archie Health or use our Services, you are creating a direct customer relationship with Archie Health that enables you to access and/or utilize the various functions of the Platform and the Service as a user. As part of that relationship, you provide information to Archie Health, including but not limited to, your name, email address, shipping address, phone number and certain transactional information, that we do not consider to be “protected health information” or “medical information”.

However, when using certain components of the Services, you may provide health or medical information that is protected under applicable law. Archie Health is a technology platform and is not itself a healthcare provider. Independent healthcare providers accessible through the Services (“Providers”) may be covered entities under the Health Insurance Portability and Accountability Act of 1996 and its implementing regulations, as amended (“HIPAA”). Archie Health may act as a business associate of a Provider when performing services involving protected health information on that Provider’s behalf. HIPAA does not apply to every person, entity, transaction, or communication involving health information.

When Archie Health acts as a HIPAA business associate, it handles protected health information (“PHI”) in accordance with HIPAA, the applicable Business Associate Agreement, and the Provider’s Notice of Privacy Practices. Medical or health information may also receive protection under applicable state law (together with PHI, “Protected Information”). We use and disclose Protected Information only as permitted by applicable law. Information that does not constitute Protected Information is handled as described in this Privacy Policy. Protected Information does not include information that has been de-identified in accordance with applicable law.

Information you submit to Archie Health for purposes other than diagnosis or treatment may not be PHI under HIPAA. For example, account-registration information such as your name, username, email address, shipping address, and phone number is not necessarily PHI. We handle such information in accordance with this Privacy Policy and other applicable privacy laws.

The personal information that we collect depends on the context of your interactions with us or on the website, and the products and website features you use. 3. Cookies, mobile IDs, and similar technologies

What cookies and similar tools are

Cookies are small text files placed by a website and stored by your browser on your device. Archie Health does not offer a mobile app; our advertising service providers may access these mobile IDs when you view or interact with our ads in other apps, subject to applicable law and your device settings.

How we use cookies and similar technologies

We and our analytics and advertising service providers use these technologies on our website and online services to collect information such as the pages you visit, links you select, identifiers, device information, and general usage information. We use this information to store preferences, enable sign-in, analyze performance, prevent fraud, and, where permitted by law and consistent with your privacy choices, deliver or measure advertising. 6. How long we keep information

Archie Health may retain your personal information for as long as it believes is necessary for the purposes set out in this Privacy Policy as long as necessary to comply with its legal obligations (e.g. tax, accounting, or other legal requirements); and/or as long as needed to provide you with the Services. Archie Health may dispose of or delete any such information at any time except as set forth in any other agreement or document executed by Archie Health or as required by law.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

Other third parties with whom we share your information have their own policies and procedures with respect to how long they may retain your information and how and when they dispose of or delete your information.

7. How we protect information

We have implemented appropriate physical, technical and organizational security measures designed to protect the security of any personal information we process. While we have in place security policies and procedures that seek to mitigate the risk of unauthorized access of your information, we cannot guarantee that the Internet is a secure medium. You should never divulge your account username and/or password to anyone else. Although we will do our best to protect your personal information, the transmission of personal information to and from our website is at your own risk. Your information may be lost during transmission or may be accessed by unauthorized parties. We do not accept any liability for direct or indirect losses with regard to the security of your personal information or data during its transfer via the internet. Please use other means of communication if you think this is necessary or prudent for security reasons.

Lastly, while we strive to use reasonable physical, technical and administrative measures to protect information under our control, you must keep your account password secure and your account confidential, and you are responsible for any and all use of your account. If you have reason to believe that the security of your Account has been compromised, please notify us immediately in accordance with the “How to contact us” section below.

8. Information from children

Archie Health serves adults 18 and older. The Services are only for individuals 18 or older. We do not knowingly provide Services to, or collect personal information from, anyone under 18. If we learn that we have collected personal information from someone under 18, we will promptly delete it from our systems, except where we are required by law to keep it. 9. Your privacy rights

Account Information: If you would at any time like to review or change the information in your account or terminate your account, you can contact us at support@archiehealth.org. Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use, and/or comply with legal requirements.

Opt Out of Email Marketing: You can unsubscribe from our marketing email list at any time by clicking on the unsubscribe link in the emails that we send or by contacting us using the details provided below. You will then be removed from the marketing email list. Please note, however, that we will still need to send you service-related emails that are necessary for the administration and use of your account. Further, to provide, correct, or delete specific pieces of personal information we will need to verify your identity to the degree of certainty required by law. We will verify your request by asking you to send it from the email address associated with your account or requiring you to provide information necessary to verify your account.

Finally, you have a right to not be discriminated against for exercising these rights set out in the CCPA. Additionally, California Civil Code Section 1798.83, also known as the “Shine the Light” law, may permit California residents to request certain information about disclosures of personal information to third parties for their direct-marketing purposes. Nevada Residents. Except for disclosures through advertising cookies that some laws treat as a “sale,” Archie Health does not sell, rent, or lease your personally identifiable information to third parties. However, if you are a resident of Nevada and would like to submit a request not to sell your personally identifiable information, you may do so by emailing us at support@archiehealth.org.

International Residents. The Service is only for people located in the U.S. Our Service is hosted in the United States. We may transfer your data from the U.S. to other countries or regions in connection with storage and processing of data, fulfilling your requests, and operating the Service. Your use of the Service is governed by U.S. law and regulation, this Policy and our Terms of Use.

10. Browser and platform controls

Cookie Controls. Most web browsers are set to accept cookies by default. If you prefer, you can go to your browser settings to learn how to delete or reject cookies. If you choose to delete or reject cookies, this could affect certain features or services of our website. If you choose to delete cookies, settings and preferences controlled by those cookies, including advertising preferences, may be deleted and may need to be recreated.

Global Privacy Control. Some browsers and browser extensions support Global Privacy Control (“GPC”) or similar controls that communicate a request to opt out of certain processing, including data sales, sharing, or targeted advertising. We honor legally recognized opt-out preference signals as required by applicable law.

Do Not Track. Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy.

Mobile Advertising ID Controls. iOS and Android operating systems provide options to limit tracking and/or reset the advertising IDs.

Email Web Beacons. Most email clients have settings that allow you to prevent the automatic downloading of images, including web beacons, which prevents an automatic connection to the web servers that host those images.

Except for the automated controls described above, if you send us a request to exercise your rights or these choices, to the extent permitted by applicable law, we may decline requests in certain cases. For example, we may decline requests where granting the request would be prohibited by law, could adversely affect the privacy or other rights of another person, would reveal a trade secret or other confidential information, or would interfere with a legal or business obligation that requires retention or use of the data. Privacy of SMS messages

Archie Health respects your privacy. No mobile information will be sold or shared with third parties for marketing or promotional purposes. Text-messaging originator opt-in data and consent will not be shared with third parties for marketing or promotional purposes. We will use your mobile number to deliver messages you requested, respond to you, support the Services, and comply with applicable law. We may disclose information as required by law, regulation, or governmental request, or to protect our rights or property. When providing information, you agree that it is accurate and not misleading. If we believe information is inaccurate or incomplete, we may restrict access to the Services.

Selecting “I Agree,” checking an acknowledgment box, or otherwise confirming through the Platform means you have received and reviewed this Privacy Policy. That acknowledgment does not replace any separate consent needed for telehealth, medical treatment, or particular uses of information.
