Patient Rights

This page explains your rights as a patient when you use Archie Health. Archie Health operates a technology platform; it is not a pharmacy or medical practice. Prescribing decisions are made by an independent licensed provider, and prescriptions are filled by GoGoMeds, a U.S.-licensed pharmacy. Archie Health serves adults 18 and older. Your rights as a patient
- Know who is treating you. You have the right to know the name, credentials, and licensure of the provider who reviews your intake and makes any prescribing decision. Care is currently prescribed by Dr. Robert Vichich, M.D., an independently licensed physician in the USHWN network. Licensing details are on our Medical Team & Licensing page.
- Get clear information before you decide. You have the right to plain-language information about the medication being considered, including its common and serious risks. Compounded medications are prepared by state-licensed pharmacies. They are not FDA-approved, and the FDA does not review them for safety, effectiveness, or quality. See our Safety Information page.
- Consent to or refuse treatment. Treatment starts only with your informed consent (see our Consent to Telehealth). You may decline a prescription, ask questions before you start, or stop treatment at any time. If you stop, tell your provider so they can advise you.
- Ask questions and get answers. Message your care team anytime; clinical questions are typically answered within 48 hours, Monday–Friday.
- Get your records. You have the right to request a copy of your medical record, as described below.
- Cancel your plan. Cancel anytime before your next billing date. Cancelling stops future renewals. Refunds follow our Refund Policy.
- Know the cost up front. All costs are shown before checkout. Archie Health is cash-pay and does not bill insurance, including Medicare or Medicaid.
- Be treated with respect and privacy. You have the right to respectful care without discrimination, and to have your health information protected as described below and in our Notice of Privacy Practices.
- Raise a concern. You can raise a concern or complaint about your care or our service, and doing so will not affect your care.
Your health information rights
You have legal rights in your health information. Those rights usually attach to records your provider keeps. You can write your provider, or ask Archie Health (using the details in the Contact us section) to help direct your request.
Request a digital or printed copy of your medical record
- You can ask to see or get an electronic or paper copy of your medical record and other health information we have about you. Ask us how to do this.
- We will provide a copy or a summary of your health information, usually within 30 days of your request. We may charge a reasonable, cost-based fee.
Ask for a correction to your medical record
- You can ask us to correct health information about you that you think is incorrect or incomplete. Ask us how to do this.
- We may say “no” to your request, but we’ll tell you why in writing within 60 days.
Choose how we contact you
- You can ask us to contact you in a specific way (for example, home or office phone) or to send mail to a different address.
- We will say “yes” to all reasonable requests.
Ask us to restrict uses and sharing
- You can ask us not to use or share certain health information for treatment, payment, or our operations. We do not have to agree to your request, and we may say “no” if it would affect your care.
- If you pay for a service or healthcare item out-of-pocket in full, you can ask us not to share that information with your health insurer for payment or healthcare operations. We will agree unless applicable law requires us to share the information.
Request an accounting of disclosures
- You can ask for a list (accounting) of the times we’ve shared your health information for six years prior to the date you ask, who we shared it with, and why.
- We will include all the disclosures except for those about treatment, payment, and healthcare operations, and certain other disclosures (such as any you asked us to make). We’ll provide one accounting a year for free but will charge a reasonable, cost-based fee if you ask for another one within 12 months.
Ask for a copy of our Notice of Privacy Practices
You can ask for a paper copy of our Notice of Privacy Practices at any time, even if you agreed to receive it electronically. We will provide a paper copy promptly.
Appoint someone to act for you
- If you have given someone medical power of attorney or if someone is your legal guardian, that person can exercise your rights and make choices about your health information.
- We will make sure the person has this authority and can act for you before we take any action.
File a complaint if you believe your rights were violated
- You can complain if you believe your privacy rights have been violated by contacting your provider or Archie Health using the details in the Contact us section.
- You can file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights by visiting hhs.gov/hipaa/filing-a-complaint or calling 1-877-696-6775.
- We will not retaliate against you for filing a complaint.
Choices about sharing
For certain health information, you can tell us your choices about what we share. If you have a clear preference for how we share your information in the situations described below, talk to us. Tell us what you want us to do, and we will follow your instructions.
In these cases, you have both the right and choice to tell us to:
- Share information with your family, close friends, or others involved in your care
- Share information in a disaster relief situation
If you cannot tell us your preference, for example, if you are unconscious, we may go ahead and share your information if we believe it is in your best interest. We may also share your information when needed to lessen a serious and imminent threat to health or safety.
In these cases we never share your information unless you give us written permission:
- Marketing purposes
- Sale of your information
- Most sharing of psychotherapy notes
